    Out of contract

When an existing customer has not renewed their contract or moved supplier at the end of their contracted period or after their contract has terminated early, the terms and conditions of their terminated or expired contract will remain in force until the customer either enters into a new contract or we cease to be registered at all supply points. In such cases, the customer will be billed on our out of contract Rates. These rates are identical to our deemed default published rates below.

When do you become out of contract?

If you are an existing energy customer that has not renewed and did not move supplier at the end of your contract, or after your contract was terminated early, you are out of contract.
The terms and conditions of your previous contract remain until you either enter into a new contract or we are no longer registered at all supply points.

    How you will be billed

When out of contract, you’re billed on our out of contract rates. These rates are the same as the deemed rates available below.

    Deemed contracts

This is a contract which is applied following a change of tenancy when the new customer has not negotiated a bespoke contract with us or when a customer is on supply but have never had a contract with us. This type of contract has default published rates which are available below. SmartestEnergy Limited is obliged under our supply license to publish a set of deemed rates for our supply of electricity and gas. The circumstances are set out in our terms and conditions.

How do I know if I’m on a deemed contract?

A deemed energy contract can come about in two ways. You could be a new owner or tenant in a building we supply and have not negotiated a bespoke contract with us. Or you could be on supply but have never had a contract with us.

The full explanation of what makes a deemed contract is in the terms and conditions, available down the page.

What are the rates for a deemed contract?

If you are on a deemed contract, you will be on a deemed rate.

We have an obligation under our supply license to publish a set of deemed rates for our supply of electricity and gas. These are listed in the link down the page.
